They have been doing this for years. When the government controls the legislation, it is easy to get round data protection issues.
It is commerce, pure and simple. When I owned the shop, I had a car par and some seemed to dump their car there. The police couldn't help, because trespass was a civil matter rather than criminal. They also said I could be liable if I arranged for the car to be removed and it was damaged. I phoned the DVLA who told me they were not "permitted" to release the information to me.
(My solution was to park the three family cars round it, boxing it, and wait, hoping it wasn't dumped and that the owner would return.)
